Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, booking pages, owner applications (web, iOS, and Android), and related services (the “Services”) provided by QBooking.ai (“QBooking,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Definitions
- “Salon” — a business or professional that uses the Services to manage bookings, staff, and payments.
- “Client” — an end customer who books an appointment with a Salon through the Services.
- “User” — any person who accesses the Services, including Salon owners, staff, and Clients.
- “Content” — information, data, text, images, and other materials submitted to or generated through the Services.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Services as a Salon or staff member. You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
3. The Services
QBooking provides software that enables Salons to publish booking pages, schedule appointments, manage staff and services, send notifications, and accept payments. QBooking is a technology provider only. We are not a party to any agreement between a Salon and its Clients and are not responsible for the services a Salon provides.
4. Subscriptions, fees, and free trial
- Paid plans are billed in advance on a recurring basis (e.g., monthly) until cancelled. Fees and plan features are described on our pricing page and may change with notice.
- Free trials, where offered, automatically convert to a paid subscription at the end of the trial unless cancelled beforehand.
- You can cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.
- We may suspend or limit the Services for non-payment.
5. Payments and payment processing
Payments are processed by Stripe. By using payment features, you agree to Stripe’s terms. When a Salon collects payment from a Client for in-person salon services, QBooking is not the merchant of record for those services; the Salon is solely responsible for the services rendered, taxes, refunds, chargebacks, and related obligations. You authorize us and our payment processor to charge applicable fees to your payment method.
6. Salon responsibilities
- Provide accurate business, service, pricing, and availability information.
- Obtain all necessary consents from Clients to collect their information and to send them SMS, email, and push communications, and comply with applicable communications and marketing laws.
- Honor confirmed bookings and handle Client requests, cancellations, and refunds for your services.
- Comply with all laws applicable to your business, including consumer protection, tax, employment, and data protection laws.
7. Acceptable use
You agree not to:
- Use the Services for any unlawful, fraudulent, or harmful purpose.
- Upload malware or interfere with or disrupt the integrity or performance of the Services.
- Attempt to gain unauthorized access to the Services or related systems or data.
- Reverse engineer, copy, resell, or create derivative works of the Services except as permitted by law.
- Send unsolicited or unlawful communications, or infringe the rights of others.
8. Content and data
You retain ownership of Content you submit. You grant QBooking a worldwide, non-exclusive license to host, process, and use that Content solely to provide and improve the Services. You are responsible for ensuring you have the rights and consents necessary for the Content you submit. Our handling of personal information is described in our Privacy Policy.
9. Intellectual property
The Services, including all software, design, text, and trademarks (excluding your Content), are owned by QBooking or its licensors and are protected by intellectual property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you.
10. Third-party services
The Services integrate with third parties such as Stripe, Twilio, and Google. Your use of those services may be subject to their separate terms, and we are not responsible for third-party services.
11. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or if we reasonably believe your use poses a risk. Upon termination, your right to use the Services ceases. Certain provisions survive termination, including ownership, disclaimers, limitations of liability, and indemnification.
12. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
13. Limitation of liability
To the maximum extent permitted by law, QBooking and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Services will not exceed the amounts you paid to us in the twelve (12) months before the event giving rise to the claim.
14. Indemnification
You agree to indemnify and hold harmless QBooking and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your Content, your services to Clients, or your violation of these Terms or applicable law.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. The courts located in Delaware will have exclusive jurisdiction, except where applicable law provides otherwise. You and QBooking agree to first attempt to resolve any dispute informally by contacting us.
16. SMS / text messaging program
By providing your mobile phone number to QBooking — for example, when you register or sign in as a Salon owner or staff member, or when you book an appointment with a Salon — you consent to receive recurring transactional text messages from QBooking related to the Services.
- Message types — one-time passcodes (OTP) for login and account verification, and appointment confirmations, reminders, changes, and other account or booking notifications.
- Message frequency — varies based on your activity (for example, with each login or each booking).
- Cost — message and data rates may apply, depending on your mobile carrier and plan.
- Opt-out — reply STOP to any message to stop receiving texts, and HELP for help. You can also email info@qbooking.ai.
- Carrier liability — mobile carriers are not liable for delayed or undelivered messages.
- Privacy — we do not sell or share mobile opt-in information, or the phone numbers collected for SMS, with third parties or affiliates for their own marketing purposes. See our Privacy Policy for details.
17. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
