Terms of Service

These terms govern your use of qBooking.ai — the AI phone-ordering platform, online ordering storefront, owner portal, and related services. By creating a restaurant account or using the service, you agree to these terms.
The service
qBooking.ai provides restaurants with an AI phone agent that answers calls and takes orders, a dedicated phone number, an online ordering storefront, menu import, order notifications (SMS, email, fax, voice), payment processing via Stripe, delivery dispatch via Uber Direct or the restaurant's own drivers, and monthly invoicing.
Your responsibilities
- Keep your menu, prices, hours, and business information accurate. The AI agent quotes what you configure.
- Honor orders the platform accepts on your behalf, or promptly cancel and refund them.
- Comply with applicable laws, including food-safety, tax, and telephone-recording notice requirements in your jurisdiction.
- Keep your portal credentials secure. You are responsible for activity under your account.
Fees and payment
- Plan fees are billed monthly, either per completed order (pay-as-you-go) or as a flat monthly subscription, per your selected plan.
- Card processing fees are charged by Stripe at its standard rates and itemized on your invoices.
- Delivery fees for Uber Direct dispatch are passed through as quoted at order time.
- Invoices are generated monthly and emailed to the restaurant. Unpaid balances may result in suspension after notice.
Orders and refunds
Customer cards are charged when an order is placed, before the order is sent to your kitchen. Cancellations initiated by the restaurant or by our support team trigger an automatic refund of the customer's payment. Disputes between a restaurant and its customer remain the restaurant's responsibility.
AI agent conduct
The AI agent answers using the menu and settings you configure and transfers to your staff line when it cannot help a caller. While the agent is designed to take orders accurately, you acknowledge that automated conversations can occasionally contain errors, and call recordings and transcripts are provided so you can verify any order.
SMS / text messaging terms
qBooking.ai sends conversational text messages to restaurant owners and operators who have opted in: replies from your qBooking.ai sales or support representative, follow-up and appointment reminders, onboarding links, and account or order notifications. You opt in by providing your mobile number on our website, by giving it to a qBooking.ai representative during a call or visit and agreeing to receive texts, or by texting a qBooking.ai number first.
- You can cancel the SMS service at any time. Text STOP to any message and you will no longer receive texts from that number. To re-join, text START.
- If you are experiencing issues with the messaging program, reply HELP for help or email info@qbooking.ai.
- Carriers are not liable for delayed or undelivered messages.
- Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have questions about your text or data plan, contact your wireless provider.
- For questions about how we handle your information, see our Privacy Policy. Mobile numbers and opt-in consent are never shared with third parties for marketing.
Acceptable use
- No unlawful, deceptive, or fraudulent use of the platform.
- No attempts to probe, disrupt, or reverse-engineer the service.
- No use of the storefront or phone number for content unrelated to your restaurant.
Termination
You may cancel at any time; service ends at the close of the current billing period and outstanding invoices remain payable. We may suspend or terminate accounts that violate these terms or create risk for customers, with notice where practical.
Disclaimers and liability
The service is provided "as is". To the maximum extent permitted by law, our aggregate liability for any claim is limited to the fees you paid us in the three months preceding the claim. We are not liable for indirect or consequential damages, including lost profits or lost orders during outages of telephony, payment, or delivery providers.
Changes to these terms
We may update these terms from time to time. Material changes will be announced on this page with a new "Last updated" date; continued use after changes take effect constitutes acceptance.
